An additional benefit to creating an estate plan is the opportunity to make sure your minor children will be taken care of in the event of your untimely death. This includes designating whom you wish to serve as guardian of your children, as well as clearly stating how those children will be cared for financially. For this reason, many people find that shortly after their children are born is a great time to begin creating an estate plan.

Probate Issues

 

Being a named executor or beneficiary in a will often comes with questions about what to do next. “Probate” is the court process that determines what happens legally to a person’s property after they’ve died. There are a variety of ways a will can be properly probated - the best option will depend on a variety of factors, including the size of the estate, the amount of assets and debts, and whether any beneficiaries or heirs want to contest the contents of the will.

Additionally, should a loved one die intestate (meaning they died without leaving a will), a court process called a Determination of Heirship is usually required to determine the legal heir(s).
